Membership to 31st December 2025
Membership Agreement
1. I have been trained on the operations of RTRFM and I understand and accept the duties outlined in my training. I understand my responsibilities as a volunteer and RTRFM's responsibilities towards me.
2. I will comply with all RTRFM policies and Code of Conduct, and any relevant regulations and legislation relevant to RTRFM, and undertake to read and comply with any further rules and regulations which are communicated to me in writing.
3. I accept responsibility for the content of my program and agree to comply with media law requirements including, but not limited to, defamation, copyright and anti-discrimination laws.
4. I recognise that in addition to RTRFM’s liability under law, I may also be liable for actions, suits, claims, losses and/or damages as a result of my comments or conduct on air. I accept personal liability for any insurance policy excess payable by the station as a result of my comments or conduct on air.
5. I agree to accept directions and decisions made by Management on program content including sponsorship announcements, presentation and technical quality, on-air conduct, access to station premises, use of station equipment and property, strategic planning, risk management and occupational health and safety, as determined by RTRFM from time to time.
6. I will comply with any changes to broadcast times as required by Management.
7. In relation to transmission of my program I agree to:
(a) be at the premises ready to present my program with sufficient time prior to broadcast; or
(b) provide a replacement presenter approved by Management; or
(c) with the consent of Management, provide a pre-recorded program at least one business day prior to broadcast time (consent should be sought prior to pre-recording as this will only be honoured in exceptional circumstances).
8. I will inform Management within 48 hours of any complaint concerning my program or any incidents that may lead to complaint.
9. As a member I understand that I am exempt from winning any competitions conducted by the station, including feature albums, Radiothon prizes and event tickets, unless otherwise stated.
10. I will not without the prior consent in writing of Management:
(a) accept any consideration or benefit in cash or kind from any third party in circumstances where it can reasonably be inferred that such third party may expect that such consideration may lead to favourable comment or editorial by me on air; or
(b) endorse the goods or services of any particular business on air with whom I have any affiliation, association, sponsorship relationship or the like, excepting in circumstances where that endorsement is as a result of customary sponsorship announcements or other agreement directly with RTRFM.
11. I agree to undertake any professional development deemed necessary by the Programming Committee to ensure the required level of on air presentation is maintained.
12. I will ensure that placement and playing of all sponsorship announcements will take place at the required time and duration during shows. Failure to do so may result in my removal from on air duties.
13. I acknowledge that RTRFM is the sole copyright owner of any Materials and is entitled to deal with these Materials without restriction.
14. I agree to not reproduce any Materials (including without limitation on audio file sharing platforms, websites, or blogs) and will not accept consideration or benefit in cash or kind from any third party from such reproduction without the express written consent of Management.
15. I assign to RTRFM all rights (including without limitation all present and future copyright throughout the world and in perpetuity) in the Materials which might, but for this agreement, vest in me.
16. RTRFM may use my name, likeness and biography for the purposes of publicity, advertising, promotion and communication to the public of the Materials.
17. I will treat station equipment, facilities and property with care. I will be responsible for any damage that I cause to station equipment, facilities or property.
18. I will not use station facilities for any purpose other than the production and preparation of my program, unless I have received prior consent to do so from Management.
19. I will not remove station equipment, CDs or property on any occasion without prior permission from Management.
20. I will not make commercial representations on behalf of RTRFM to any person or organisation without prior written authority from Management.
21. I will treat other volunteers, staff, Management and station guests with consideration and respect.
22. I will not broadcast any adverse public comments on the operation of RTRFM or any staff member or volunteer without prior approval from Management.
23. I agree that a breach of the above conditions may result in the suspension or termination of my broadcasting rights and may in some situations lead to a revocation of my membership.
24. I will treat, as confidential, all information which comes into my possession under this agreement or as a result of my activities as a presenter with RTRFM, such as commercial, operational, technical or financial nature relating to the affairs, finances, business practices, clients, marketing or business plans of RTRFM, but excluding information that was public knowledge when this agreement was signed or became so at a later date (other than as a result of a breach of confidentiality by me).
25. I acknowledge Management's grievance procedures as the appropriate avenue for conflict resolution.
DEFINITIONS
“Board” means the directors of RTRFM properly constituting the board of RTRFM in accordance with RTRFM’s constitution as amended from time to time.
“Management” means a director or directors of RTRFM including, but not limited to, the General Manager or any authorised agent of RTRFM (excluding ordinary non-management members).
“Materials” are the copyright in any audio, visual or written content created by me for the purpose of broadcast on, or publication through any RTRFM platform, with the exception of content provided to RTRFM under the terms of a licence other than RTRFM's licence to broadcast issued by the Australian Communications and Media Authority.
“General Manager” means the general manager of the station as employed by the Board from time to time.
I have read and accept the member agreement outlined above.
